WAIVER, RELEASE OF LIABILITY & COVENANT NOT TO SUE

For and in consideration of voluntary participation in the activity of “mountain biking” arranged and coordinated by MONUMENT MOUNTAIN BIKERS, an social group located in and/or around Monument, Colorado, [hereinafter referred to and designated as “Monument Mountain Bikers”], I individually agree for myself, my heirs, executors, administrators, successors and assigns THAT I ASSUME ANY AND ALL RISKS OF PARTICIPATING AND/OR VOLUNTEERING IN THIS VOLUNTARY MEET-UP “MONUMENT MOUNTAIN BIKERS” social group.

I acknowledge that mountain biking involves a test of a person’s physical and mental limits and may carry with it the potential for death, serious injury, and property loss. The risks may include, but are not limited to those caused by terrain, facilities, temperature, weather, condition of participants, lack of hydration, equipment, vehicular traffic, actions of other people including but not limited to, participants, volunteers and spectators and other persons on or along the routes which may include but are not limited to trails, sidewalks, roadways, bodies of water and railroad crossings.

It is my responsibility to understand my skills and the skills needed for each ride. The participants and organizers are not experts on teaching skills or guides, and I am solely responsible for understanding the skill level and physical demands needed for this activity. If this or any event arranged or coordinated by Monument Mountain Bikers exceeds my skill level or fitness, it is my responsibility to stop, limit, or not further participate. I acknowledge that I am a volunteer participant and not forced to participate or continue on any organized activity at any point. I acknowledge that the decision to attempt any trail, trail feature, maneuver or obstacle encountered while riding with Monument Mountain Bikers, will be made entirely by me, without coercion or influence, and with a full understanding and awareness of the risks to me associated with such trail, feature, maneuver, or obstacle and the resultant risks. I take responsibility for my bike and biking equipment, its condition and safety as well as all safety precautions and equipment including but not limited to helmets, padding and body armor. I understand that equipment failures and maintenance are my responsibility and may occur in remote areas necessitating removal of my equipment and myself. Members and organizers of events are not responsible for condition, or repair of my equipment or physical removal of myself or my equipment return from such locations.

I represent and warrant that I am in good health and have no medical condition(s) or disabilities that restrict or impede my ability to participate in bike riding.  I acknowledge that I have all necessary medications or aids that I might require in the event of a known medical issue (such as allergy medications, epi-pens, etc.).  I acknowledge that I’m not relying on Monument Mountain Bikers or any of its volunteers or participants associated with Monument Mountain Bikers for medications and I am not relying on Monument Mountain Bikers or any of its volunteers or participants to provide first-aid supplies or any other medical treatment, I understand that it is my responsibility to carry any medical supplies I might need, and I waive any claim against Monument Mountain Bikers to provide medical treatment or care of any kind during any ride. 

INDEMNIFICATION:  I agree to indemnify and defend Monument Mountain Bikers from and against any and all claims, causes of action, damages, judgments, cost and/or expenses, including attorney’s fees and other litigation costs which may, in any way, arise from my used of and/or presence at any activity of Monument Mountain Bikers activities. I HEREBY RELEASE, HOLD HARMLESS AND PROMISE NOT TO SUE any and all the organizers and/or participants of Monument Mountain Bikers, including its volunteers, representatives and agents, from any and all damages, claims and/or causes of action arising from or being caused by the alleged negligence and/or fault of the organizers and/or participants of Monument Mountain Bikers for any personal injury and/or disability, death, emotional duress, property damage, property theft or any other damages, claims and causes or action arising out of my participation in such activity and/or event. including but not limited to, traveling to and from the activities of Monument Mountain Bikers and I waive and release any claim for damage and I AGREE NOT TO SUE regarding any and all matters described in this agreement. I waive any right to a jury trial for any claims arising from or related to any activities of Monument Mountain Bikers.

I understand I may be photographed at this event or activity. I agree to allow my photo, video, or film likeness to be used for any legitimate purpose by Monument Mountain Bikers and/or their assigns.

I CERTIFY THAT I HAVE READ THIS DOCUMENT AND I FULLY UNDERSTAND ITS CONTENTS. I AM AWARE THAT THIS IS A CONTRACTUAL WAIVER AND RELEASE OF LIABILITY, COVENANT NOT TO SUE AND I SIGN IT OF MY OWN FREE WILL.
